What is a hospital or bedside notary?

A bedside notary is a mobile notary who comes to a patient instead of asking a patient to come to them. When someone is admitted, recovering, or homebound, a critical document still needs a witness and an official seal, and the signing cannot wait for a trip to the bank.

The notary's job at the bedside is the same as anywhere else. We confirm the signer's identity with a valid photo ID, make sure they are signing willingly, watch them sign, and apply the seal that makes the document legally recognized. We do not draft documents or give legal advice. We verify who signed and that they did so freely.

What changes at the bedside is the setting. We work around nursing rounds, visiting hours, and the care team's schedule, and we stay calm and patient with families during a stressful time.

When do families need a bedside notary?

Most bedside calls come during a turning point in someone's care. A procedure is scheduled, a diagnosis just landed, or a relative wants their affairs in order while they still can. These signings are time-sensitive and emotional, and they are exactly where a mobile notary matters most.

The documents families sign at the bedside usually include:

• A power of attorney notary appointment, both durable financial and medical
• Healthcare and advance directives, including living wills
• Wills, trusts, and estate documents
• Affidavits and consent forms tied to care or finances

Timing is the common thread. A family may need a power of attorney signed before surgery, or a directive in place before a transfer to another facility. We answer the phone, confirm a window, and come to the room.

What if the signer cannot physically sign?

Illness and weakness sometimes make it hard to hold a pen, but that does not have to stop a notarization. Missouri law provides for a signature by mark, where the signer makes an X or another mark that the notary documents, often with witnesses present.

The law also allows a directed signature. If the signer cannot make a mark at all, they may direct another person to sign their name for them, in their presence and at their explicit request. The notary records exactly how the signing happened.

The non-negotiable part is awareness. The signer must understand the document and clearly communicate consent. We cannot notarize for someone who is sedated, heavily medicated, or confused. If the signer is not lucid when we arrive, we will reschedule for a time when they are alert.
